Hun veroordeling schendt hun rechten op vrijheid van meningsuiting, vereniging en vergadering.

Council of Europe denounces lack of Spanish compliance in judicial independence

13 november 2019 – The Council of Europe has denounced Spain's lack of compliance in judicial independence, following up on an evaluation report done in 2013.
The Group of States Against Corruption (GRECO), the institution's anti-corruption monitoring body, calls for "an overall anti-corruption strategy and effective implementation of laws" in the country.
In their report, released on Wednesday, they praised some actions taken by Madrid, and so their grade of compliance to the body's 2013 advice is no longer "unsatisfactory."

Europees Parlement gaat zelf over zetel Catalaanse oud-vicepremier

12 november 2019 – Het Europees Parlement moet zelf kunnen beslissen of de Catalaanse oud-vicepremier Oriol Junqueras Vies onschendbaar is nu hij is gekozen als Europarlementariër. Met dat advies komt de advocaat-generaal in een zaak bij het Europese Hof van Justitie.
De Catalaan kreeg in mei in Spanje voldoende stemmen om voor een zetel in het Europees Parlement. Hij zit echter al sinds 2017 vast voor zijn rol in de organisatie van het verboden onafhankelijkheidsreferendum in Catalonië. Hiervoor werd hij vorige maand veroordeeld tot dertien jaar cel.

Dialoog in Spanje over onafhankelijk Catalonië is ver te zoeken

29 oktober 2019 – Afgelopen weekend waren er wederom massademonstraties in Barcelona. Honderdduizenden mensen gingen de straat op, aldus de Spaanse politie. Dat vanwege de jarenlange straffen die zijn opgelegd aan negen separatistische leiders.
De voormalig Catalaanse president Carles Puigdemont was het gezicht van het Catalaanse onafhankelijkheidsreferendum in 2017. Hij begeeft zich inmiddels al langere tijd in België. Dat vanwege een internationaal arrestatiebevel dat tegen hem is uitgevaardigd. Dinsdag besluit de Belgische rechtbank of Puigdemont wel of niet wordt uitgeleverd aan Spanje. We praten erover met journalist en schrijver Edwin Winkels die in Barcelona woont.

Is het Catalaans geduld op?

20 oktober 2019 – Toen op de Spaanse nationale feestdag vorige week uitlekte dat de negen Catalaanse politieke gevangenen voor samen 100 jaar cel zouden veroordeeld worden, keek niemand verbaasd op. Toch was het officiële vonnis maandag een kaakslag die de Catalaanse volkswoede deed losbarsten. Van indepes tot unionisten, voor een grote meerderheid Catalanen zijn deze veroordelingen meer dan een brug te ver. Zelfs Catalaans oud-minister-president José Montilla, unionist en van dezelfde partij als premier Sánchez (PSOE), sprak van onbegrijpelijk harde straffen. Ondertussen loopt het in de Catalaanse straten uit de hand.

19 oktober 2019 – Mensenrechtenorganisatie Amnesty International heeft het "excessieve geweld" van Spaanse agenten tegen betogers bij vreedzame massaprotesten in Catalonië veroordeeld. Agenten zouden onder andere op zéér korte afstand met rubberen kogels op demonstranten hebben geschoten om menigtes uit elkaar te drijven.

Spaanse Justitie neemt wraak

15 oktober 2019 – De kogel is door de kerk: de negen Catalaanse politieke gevangenen krijgen celstraffen van 9 tot 13 jaar opgelegd voor hun rol in het onafhankelijkheidsreferendum. Ondertussen staat Catalonië in rep en roer: tienduizenden betogers kwamen gisteren (maandag 14 oktober 2019) op straat en blokkeerden autosnelwegen, stations en de luchthaven van Barcelona. De Spaanse politie, massaal opgetrommeld vanuit Madrid, én de Catalaanse Mossos treden hard op tegen de manifestanten. Er wordt verwacht dat de protesten zullen doorgaan de komende dagen.

Nu nog zwijgen over Catalonië is schuldig verzuim

14 oktober 2019 – Spanje perkt via de rechter de politieke rechten en het recht op vrije meningsuiting in. Een politieke beweging, die door de Spaanse staat als ongewenst wordt gezien, wordt zo gecriminaliseerd. Politieke tegenstanders worden veroordeeld en opgesloten als misdadigers. Met dank aan juridische containerbegrippen zoals ‘opruiing’.

Reacting to the body’s request for the “immediate” release of politicians Oriol Junqueras, Jordi Sànchez and Jordi Cuixart, Madrid has demanded that the members be disqualified for allegedly being close to Emmerson.

26 april 2019 – The European Union has urged Spain to analyze why citizens’ faith in judicial independence has dropped from last year, following a report which ranks Spain as the fourth worst among the 28-member EU.

3 april 2019 – ‘Ik begin te denken dat u er helemaal niets van begrijpt.’ Na een paar minuten interview verdwijnt het glimlachje van het gelaat van Josep Borrell. De Spaanse minister van Buitenlandse Zaken windt zich op. ‘Wat weet u eigenlijk van deze zaak?’ bijt hij interviewer Tim Sebastian van Duitse tv-zender Deutsche Welle toe. Die blijft de rust zelve.
Sebastian heeft zijn interview goed voorbereid. 16 maart 2019 – Thousands of Catalan separatist supporters marched in Madrid on Saturday in protest over the ongoing trial of 12 separatist leaders who face up to 25-year-prison sentences for their role in the failed independence bid.
The demonstration through Spain's capital was organised by two civil society groups the Catalan National Assembly (ANC) and Òmnium Cultural and led by Catalan leader Quim Torra.

Probably, he opted for the path knowing full well that, on the one hand, the public prosecutors could help him to ‘fine tune’ his propositions, and on the other, that the political establishment could, to paraphrase a famous leaked message, control the key courts ‘via the back door.’ However, what never occurred to him was that the situation might get out control because a group of madmen would cross the Pyrenees and engage him in battle on a level playing field and with an impartial referee.

Vergeleek de Spaanse staatssecretaris Irene Lozano het Catalaanse referendum over onafhankelijkheid van 2017 met een verkrachting, waarvoor de organisatoren gevangenisstraffen tot 25 jaar verdienen? ‘Nee, haha.’ Lozano leek de vraag wel grappig te vinden. ‘Misschien heb ik me niet goed uitgedrukt. Wat ik zeg is dat seks goed is, maar zonder toestemming wordt het verkrachting. Stemmen is ook oké. Maar als je er geen toestemming voor hebt, is het in Spanje een strafbaar feit.’

The speaker of the House of Commons at the UK Parliament, John Bercow, said that he would accept a debate on independence in the chamber. After a question by MP Hywel Williams, the chair of the All-Party Parliamentary Group on Catalonia, Bercow said he would greenlight a discussion over a potential breakup of Wales.
It is of course entirely orderly for there to be a debate in this house on Welsh independence, he stated. Members enjoy immunity for the words they utter in this chamber, and can come to no grief as a result of their freedom of expression.

11 januari 2019 – After more than 14 months in pre-trial detention, Oriol Junqueras, the former vice president of the Catalan regional government, is set to go on trial January 22, 2019, in Madrid on charges of ‘rebellion, sedition, and misuse of public funds’ — for his central role in organizing the October 1, 2017, referendum on Catalonian independence. That referendum was disrupted by the intervention of Spanish riot police, who seized ballot boxes and dispersed voters in brutal actions, after the Spanish executive and judicial authorities had declared the vote illegal. An investigation by Human Rights Watch concluded that police used excessive force when confronting voters and demonstrators, hitting non-threatening protestors with batons and resulting in 893 reported injuries.
